Terms of Service
(Valid from 1st January, 2019)
Glow Concierge GmbH (hereafter "Glow Concierge"or “we”) uses its platforms (hereafter referred to as the "Platform") to provide services in the field of beauty, wellness and fitness (hereafter "Services") through independent partners (hereafter "Partners" ) to the client (hereafter "you"). The platform provides information about the nature, content and design of the services.
Unless otherwise agreed in writing, all of the services offered on the platform are governed exclusively by these General Terms and Conditions in their current version (hereinafter "GTC"). The current version of the Terms and Conditions is available at https://glowconcierge.ch/page/terms
Glow Concierge reserves the right to change these terms at any time. The changed terms and conditions will become effective upon publication on the platform.
Glow Concierge does not offer the services directly to the customers, only acting as an intermediary and does not employ any partners. Glow Concierge makes no warranty, and makes no representations as to the reliability, quality or fitness of the partner.
Swiss law is exclusively applicable. The place of jurisdiction is in Zurich, Switzerland.
Performance by Glow Concierge
Glow Concierge provides a platform through which we provide the services that enable introductions between customers seeking services and our network of partners. Our services are limited to making the platform available, implementing launches, managing bookings, and acting as a limited collection agent on behalf of our Partners for the collection of the partner's fee.
We do not enter into any contracts with customers for the provision of provider services. By booking services through the Platform, you enter into an agreement with the applicable partner for the provision of these services, and we assume no responsibility or liability and make no warranty, representation or warranty with respect to the partner's performance under this Agreement.
Any use of the platform, service or service provided by persons under the age of 18 is expressly prohibited, unless there is proof of the parent or guardian.
To create a user account on the platform, registration is required. You are obligated to fill in and keep up-to-date all necessary information in the context of a registration correctly and truthfully. You are also responsible for the security of your password. It is not allowed to create accounts automatically.
You agree not to interfere or interrupt the Platform in any way.
You agree not to reproduce, copy, sell, trade or redistribute the Platform or the Services offered thereon for any purpose.
Customers can use the platform to book different services at a time of their choice. To make a booking, you should follow the instructions on the platform and provide the required information. Glow Concierge will make reasonable efforts to find a partner who will be able to provide this service at the desired time. In the unlikely event that Glow Concierge does not find a partner for the specific time window, we will contact you to find an alternative time.
The client may request a specific partner, but Glow Concierge cannot guarantee that they will be available when the time is right. If they are not available, Glow Concierge will suggest alternatives or arrange a different time with the client when the desired partner is available. Once Glow Concierge has found a partner available on time, Glow Concierge will ask the client to confirm the booking by email and / or push notification via the platform. Once a booking has been confirmed, the client will need to pay the partner’s fee through the website's payment system. In the event of a customer or partner cancellation, the retention or reimbursement of fees (if applicable) will be in accordance with our cancellation and refund policy, which may be viewed here: https://glowconcierge.ch/page/faqs and forms part of these terms.
As a customer, you are solely responsible for ensuring that the services you choose are suitable for you. You should alert your partner to pre-existing illnesses (physical or mental) before starting a session.
If you have any doubt as to whether a service is suitable for you, you should discuss this with our partner and consult a qualified physician before proceeding.
We ask you to treat all our partners with courtesy and respect, and to provide them with a safe, clean and adequate place to perform the service. Our partners are entitled to refuse service if you have not provided them with a safe, clean, and reasonable place to do so, or if you oppose them in a manner that is rude, disrespectful, abusive, or otherwise inappropriate.
You must provide complete and accurate information about your services on the Platform and keep it up to date. This information (including prices) is binding for you.
Appointment bookings you receive from customers via the platform are binding. This means that your customers rely on the fact that the booked appointment can actually take place. If the deadline cannot be met, you are responsible for contacting Glow Concierge immediately.
You undertake to offer your services professionally, to pay attention to punctuality, well-groomed appearance, high quality of products and treatments, clean, accurate and hygienic work.
With respect to each booking, the customer is required to pay the partner fee of the amount stated on the website at the time of booking. The partner fee is payable to the responsible partner for the provision of the service.
Glow Concierge will either: (a) collect the partner fee from the client in his capacity as collection agent for the account of the partner; or b) arrange for the partner fee (minus a commission) to be paid directly to the partner through their third party payment system. We reserve the right to change fees at our sole discretion at any time. The applicable fees will be communicated to you via the platform at the time of booking. An increase in fees will not apply to confirmed bookings prior to the publication of the revised fees on the platform.
Glow Concierge arranges a commission for booking the services with each partner. The commission is calculated as a percentage of the total partner fee for each booking.
Cancellation is only possible within the specified time frame and under the conditions described. If the customer is entitled to a refund of the partner's fee, the partner undertakes to arrange the reimbursement within a maximum of 7 days.
No conclusion of contract outside the platform
Texts and pictorial representations, which a partner publishes on the platform in any form or form, may not target or directly or indirectly request the conclusion of contracts outside the platform. After the first provision of a service to a customer, all follow-up services are also to be completed via the platform. The fee is also due for all follow-up services.
Property, use and intellectual property rights
The platform and all intellectual property rights therein, including but not limited to content, are the property of Glow Concierge. Intellectual property rights include copyright, trademarks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind, whether registered or unregistered (anywhere in the world).
Accuracy of information and availability of the platform
While we try to ensure that the platform is correct, up-to-date and free of errors, we cannot promise that this will happen. In addition, we cannot promise that the platform is suitable for any purpose. The trust you place in the information on this site is at your own risk. We may suspend or discontinue the operation of the Platform at any time, as we believe is right. All content is for general information purposes only and to inform you about us and our services.
Hyperlinks and third party websites
The Platform may contain hyperlinks or references to websites other than the Platform. Such hyperlinks or references are provided for your convenience only. We have no control over third party websites and assume no legal responsibility for the content, materials or information contained therein. The presentation of hyperlinks and references to third party websites does not mean that we support the websites, products or services of these third parties. Your use of a third party website may be subject to the terms of this third party website.
We are not responsible or liable for the performance of a booking, for the performance of services by a partner, or for acts or omissions by partners during their provision of the partner services, including any damage they may cause to property. We make no warranty or guarantee and we make no representations as to the reliability, quality or fitness of the partner. This responsibity is taken by the partner.
Nothing contained on the platform is any advice or recommendation. We are not a healthcare provider and do not provide medical advice or medical treatment. References to the "treatment" and "therapy" platform do not refer to medical treatment or medical therapy. The information presented on the platform is not intended to diagnose health problems or to replace professional medical treatment. If you have a medical problem, you should always consult a qualified doctor. We make no representation that the information on the platform is error-free, timely, reliable, completely secure, virus-free or available for your intended use. We give no guarantee for specific results or results through the use of the Site or Site Services.
By using the Services, you agree to indemnify and hold Glow Concierge unaccountable from any liability or responsibility for any damages that may result from the transaction between you and our partner. Responsibiltiy is taken by the Partner.
The contractual relationship begins with the registration and registration by the customer and lasts until the customer closes his user account on the platform. However, the contractual relationship lasts at least until the services booked by the customer are provided or have been cancelled in accordance with these Terms and Conditions.
The contract begins with the registration of the partner, or upon receipt of the partner's signed contract with Glow Concierge. The contractual relationship is concluded for an indefinite period and can be terminated by either party subject to a one-month notice period at the end of each month.
The immediate termination of the contractual relationship for cause remains at the parties' discretion. An important reason for the immediate dissolution of this contract is in particular, if a party falls into bankruptcy or the bankruptcy was terminated for lack of assets, if the customer or the partner with payment obligations under this contract is in default and he was unsuccessfully reminder after setting a grace period or if a party violates obligations under the contract.
